Consultation on the Contribution of Fishing Rights-Related Activity Compensation to Qualified Retirement Plans

The Department of the Treasury and the Internal Revenue Service will host a phone consultation on Tuesday, December 10, at 4:00 p.m. EDT to discuss recently issued proposed regulations clarifying the treatment of fishing rights-related activity income for qualified retirement plan purposes. The proposed regulations add a narrow exception to the existing regulations under section 1.415(c)-2(b) that would allow income from an Indian fishing rights-related activity to be treated as compensation. As a result, Indian tribal members who earn compensation for services performed in a fishing rights-related activity are able to contribute that compensation to a qualified retirement plan. The regulations impact sponsors of and participants in employee benefit plans of Indian tribal governments, as well as individual tribe members who earn compensation from Indian fishing rights-related activities.
