The Department of the Treasury and the Internal Revenue Serv ice will host a phone consultation on Tuesday\, December 10\, at 4:00 p.m. EDT to discuss recently issued proposed regulations clarifying the treatmen t of fishing rights-related activity income for qualified retirement plan p urposes. The proposed regulations add a narrow exception to the existing re gulations under section 1.415(c)-2(b) that would allow income from an India n fishing rights-related activity to be treated as compensation. As a resul t\, Indian tribal members who earn compensation for services performed in a fishing rights-related activity are able to contribute that compensation t o a qualified retirement plan. The regulations impact sponsors of and parti cipants in employee benefit plans of Indian tribal governments\, as well as individual tribe members who earn compensation from Indian fishing rights- related activities.
