Limits On SDVCJ Eligible Crimes

For a tribe to exercise jurisdiction over a non-Indian offender:

  • the victim must be Indian;[1] and
  • the crime must take place in the Indian Country of the participating tribe.[2]

The tribe can only exercise jurisdiction over a non-Indian if the offender:

  • resides in the Indian Country of the participating tribe;
  • is employed in the Indian Country of the participating tribe; or
  • is a current or former spouse, intimate partner, or dating partner of a member of the participating tribe, or an Indian who resides in the Indian Country of the participating tribe.[3]
